what valid point are you talking about ? He admitted that he knew that he was taking something prohibited . He just speculated to no get caught that time .

No, actually he makes a valid point. If it’s not illegal, then it’s not illegal. If you can legally purchase it, then it should be ok to use. If later became banned, then they would need to discontinue its use. I do believe however there is more to the story. Despite his logical reasons the NSAC still fined him and suspended him, so I’m guessing they decided he should have known better.
